These Terms and Conditions govern the sale of goods by Team Gekko LTD (“we”, “us”, or “our”) to you, the customer (“you” or “your”), via our website [https://teamgekko.com] (the “Site”). By placing an order, you agree to be bound by these terms.
1. Products and Customisation
1.1 We offer standard and customisable products including apparel, signage, and accessories.
1.2 Customisable products are made to your specifications, including but not limited to names, graphics, logos, colours, and sizing.
1.3 You are solely responsible for ensuring the accuracy of customisation details provided at the time of order.
1.4 We reserve the right to reject any order containing artwork or text that is offensive, discriminatory, unlawful, or infringes third-party rights.
2. Artwork Approval
2.1 Where applicable, we will provide a digital proof of your custom design for approval before production.
2.2 You must approve or request changes in writing (email or through our online platform) before we begin production.
2.3 Delays in artwork approval may delay your delivery schedule.
2.4 Once artwork is approved, we are not liable for any errors, omissions, or issues not raised prior to production.
3. Orders
3.1 Orders are subject to acceptance and availability.
3.2 Order confirmation emails confirm receipt but not acceptance. Acceptance occurs when production begins or items are dispatched.
3.3 We reserve the right to cancel or amend orders due to errors in pricing, availability, or breach of these terms.
4. Pricing and Payment
4.1 All prices are shown in [GBP], inclusive of VAT where applicable.
4.2 Prices may change at any time; confirmed orders are not affected.
4.3 Payment is due in full at the time of order via card payment.
5. Delivery
5.1 Estimated delivery times are shown at checkout. These are indicative and not guaranteed.
5.2 You will be notified when your order is dispatched.
5.3 We are not responsible for delivery delays caused by carriers, customs, or force majeure events.
5.4 Risk of loss passes to you upon delivery.
6. Returns and Refunds
6.1 Customised items (including printed apparel, personalised signage, or bespoke accessories) are non-returnable unless faulty.
6.2 Faulty or incorrect items must be reported within 7 days of delivery with accompanying photos and a description of the issue.
6.3 Standard (non-customised) items can be returned within 14 days under Consumer Contracts Regulations. Returned items must be unused and in original packaging.
7. Reseller and Commercial Use
7.1 If you purchase products for resale, you agree not to misrepresent the origin or branding of the items.
7.2 Our name, trademarks, and logos may not be used without express written permission.
7.3 We reserve the right to refuse supply to resellers or commercial buyers who breach brand guidelines, undercut retail pricing agreements, or misrepresent product origin.
7.4 Any resale or commercial use must comply with applicable local and international trade laws.
8. Intellectual Property and Uploaded Content
8.1 You retain ownership of all original artwork you provide but grant us a non-exclusive, royalty-free licence to use, reproduce, and adapt it for the sole purpose of fulfilling your order.
8.2 By submitting artwork, you confirm that you have full rights to use all designs, logos, and content, and that it does not infringe any third-party rights.
8.3 We may keep records of custom designs for quality control, future reordering, or promotional samples (unless you request otherwise).
9. Limitation of Liability
9.1 We are not liable for indirect, incidental, or consequential loss arising from your use of our site or products.
9.2 Our liability for any claim will not exceed the amount paid for the product in question.
10. Privacy and Data
10.1 Your personal data is handled in accordance with our Privacy Policy.
10.2 We do not store credit card details or share your information with third parties without your consent, except where required to fulfil your order.
11. Governing Law
11.1 These terms are governed by the laws of England and Wales.
11.2 Any disputes shall be resolved in the courts of England and Wales.
